1. Agreement

These Terms of Service ("Terms") govern your access to and use of IGSender, an Instagram automation platform operated by Growthlinker Private Limited at igsender.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Who can use IGSender

You must be at least 18 years old and able to enter a binding contract under the laws of India (or the country you reside in). You must own or be expressly authorized to manage every Instagram account you connect to the Service. You are responsible for keeping your login credentials secure.

3. Acceptable use

You agree not to use the Service to:

Send spam, unsolicited bulk messages, or content that violates Instagram's policies
Harass, threaten, defame, or impersonate any person
Distribute malware, phishing links, adult content, or anything illegal in your jurisdiction
Scrape, reverse-engineer, or attempt to gain unauthorized access to the Service
Resell or sublicense the Service without our prior written consent
Use the Service in any way that would violate the Instagram Community Guidelines or Meta Platform Terms

We may suspend or terminate accounts that violate these rules.

4. Instagram automation responsibility

IGSender operates exclusively through the official Meta Graph API and is designed to comply with Instagram's platform policies. You are responsible for the content of messages your campaigns send and for ensuring your usage complies with Instagram's Community Guidelines and Meta Platform Terms. IGSender does not guarantee specific outcomes and is not liable for any platform-level actions taken by Meta in accordance with their own policies.

5. Plans, billing and taxes

We offer a Free plan and paid plans (Pro Monthly and Pro Annual). Paid subscriptions are billed in advance on a recurring basis — in Indian Rupees (INR) through Razorpay in India, with GST included on every invoice, and in US Dollars (USD) through Stripe elsewhere.

You may cancel at any time; cancellation stops future renewals but does not refund the current billing period except as set out in our Refund & Cancellation Policy. We may change pricing with at least 30 days' notice before your next renewal.

7-day Pro trial. First-time Pro users may start one 7-day trial per person: ₹7 in India, or free with a card on file elsewhere. A trial is an automatically renewing subscription. By starting it you authorise us to charge the monthly Pro price (₹589 including GST, or $5.99) when the trial ends and every month after, until you cancel. You can cancel online at any time before the trial ends in Settings → Subscription and will not be charged. We email you when the trial starts and 2 days before the first charge. The trial fee and the first monthly charge after a trial are non-refundable, as set out in our Refund & Cancellation Policy.

6. Refunds & cancellations

7. Your content and data

You retain ownership of all content you submit, including campaign copy, audience data, and contacts saved through your campaigns. You grant IGSender a limited, non-exclusive license to host, process, and display that content solely to operate the Service for you.

8. Intellectual property

The IGSender brand, logo, website, software, and documentation are owned by Growthlinker Private Limited and protected by copyright and trademark laws. You may not copy, modify, or distribute them without permission.

9. Service availability

We strive for high availability but do not guarantee that the Service will be uninterrupted or error-free. Scheduled maintenance, third-party outages (including Meta Graph API outages), and force majeure events may cause downtime.

10. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, Growthlinker Private Limited and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from or related to your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

12. Indemnification

You agree to indemnify and hold harmless Growthlinker Private Limited from any claims, damages, or expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or any law.

13. Termination

You may stop using the Service at any time and delete your account from your settings. We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends immediately.

14. Changes

We may update these Terms from time to time. Material changes will be notified by email or an in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

15. Governing law & jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Jamshedpur, Jharkhand, India.
